A jury has heard a correctional officer was intending to do 'really serious bodily harm' when he fatally shot an inmate who was attempting to escape custody from a hospital in northern NSW.

Mr McKay said Officer A yelled, "Correctional officer, stop or I'll shoot", before firing his revolver three times.Mr McKay said the third shot could not be seen in the CCTV vision but hit Mr Johnstone in back and led to his death.The court heard Mr Johnstone was handcuffed and shackled at the ankles throughout his hospital treatment and during his escape attempt.

He said it would be up to the jury to decide whether or not Officer A had a lawful reason to fire his gun, and whether or not he had done so intending to cause grievous bodily harm or with a reckless indifference to human life.The trial is expected to run for four weeks.
