Brian Burston sued One Nation leader Pauline Hanson in the Federal Court claiming she accused him of sexual harassment on social media, in a text message to his wife and in a television interview.
One Nation leader Pauline Hanson has successfully appealed the verdict of a defamation lawsuit brought by former senator Brian Burston in which he was awarded $250,000 in damages.Three judges today overturned the findings of the defamation caseMr Burston sued Senator Hanson in the Federal Court claiming she accused him of sexual harassment on social media, in a text message to his wife and in a 2019 Channel Nine television interview.
Justice Robert Bromwich said he was in no doubt Mr Burston sexually propositioned two staffers but ruled Senator Hanson did not have any proper basis for suspecting that Mr Burston's conduct went so far as to constitute sexual abuse. They said the imputation that Mr Burston sexually abused a female staffer in his parliamentary office was "substantially true".
"To the contrary, the statement was used in the context that it was not a physical fight, but that Mr Burston was the physical aggressor as Mr Ashby had not laid a hand on, or physically touched Mr Burston," they wrote.Abuse of power in the workplace is a serious issue: Hanson "Today was the end of a long battle that started with my speech in the Senate in February 2019 exposing a fellow senator of sexual harassment of his staff," she said.
