“What would change is the balancing test that must be performed by the officer when deciding whether or not to engage in the pursuit,” he told Goodman and the other lawmakers. “Under current law, the balancing test is that the person who’s being pursued must pose a serious risk of harm to others and the risks of failing to apprehend or identify the person must be considered greater than the safety risks of the pursuit.
