Marcus Sapp no longer has the threat of a murder trial hanging over his head.

Sapp had spent 13 years in prison for the crime, but his conviction was overturned a year and a half ago. A retrial seemed likely until Wednesday.

The office said it wouldn't have had enough witnesses, the lead detective retired, and memories have faded. "Marcus Sapp is a killer. A jury of his peers determined he was a killer. Our certainty of that fact hasn't changed in the fifteen years since he was indicted. The only thing that has changed in that time is our ability to successfully prosecute the case against him a second time," said Powers."The prosecutor should be down on her knees apologizing to Marcus instead of releasing stupid statements," Sapp's attorney Marty Pinales.

"He's been living with this cloud over his head for more than a year just waiting to be retried, and he's had to go back to court for all these different hearings just living with the constant stress," said Ohio Innocence Project attorney Kate Flexter.
