In a statement issued after the hearing, Arizona Attorney General Kris Mayes described the defendants’ motions as an effort to “deflect from the facts of this case and muddy the waters in the public eye.”Defense attorneys base their case on a free speech argument On Wednesday, they cited an Arizona law that bars using baseless legal actions in a bid to silence critics. They also said Mayes campaigned on investigating fake electors and showed a bias against Trump and his supporters. The law in question, commonly referred to as an anti-SLAPP statute, had long offered protections from civil lawsuits before it was amended in 2022 by the Republican-led Legislature to cover people facing most criminal charges.

The anti-SLAPP law has not been used in a criminal case since it was modified in 2022, according to a spokesperson for Mayes.
