The Berliner pub in Chilwell, Nottinghamshire, is facing rejection of its application to retain its beer garden after Broxtowe Borough Council deemed it lacked proper planning permission. The pub owners erected a sound-proof fence in an attempt to mitigate noise complaints from neighbours, but the council's planning committee is advised to reject the proposal.

A pub's fight to keep open a beer garden which was ordered to be taken down by a Nottinghamshire council has been dealt a major blow. The owners of the Berliner in High Road, Chilwell were told to remove the outdoor area when Broxtowe Borough Council realised it did not have the correct planning permission in 2023.

The retention of the beer garden will have a "significant impact" on the living conditions of nearby residents due to "noise and disturbance", the report says. It cites an objection from one neighbour who said pub-goers are still congregating in the broader car park area. Three other neighbours who were consulted supported the application. In the report, planning officers write: "The retention of the use of the courtyard for an outdoor seating and smoking area will have a significant impact on the living conditions of nearby residents by virtue of additional noise and disturbance emanating from the premises, above what can reasonably be expected in a predominantly residential area.
