Opponents of a Nebraska private school funding measure passed on the last day of the legislative session are considering how to fight it. They could renew a petition effort to give voters the option to repeal the measure in November.

But school choice backers will likely argue that because the new funding law is a direct state appropriation, a ballot initiative would violate a Nebraska Constitution ban on referendums on the Legislature’s taxing authority.
