Pre-trial therapy is sometimes a limited form of counselling if it is agreed that survivors do not talk about facts related directly to their case.
“A victim gets therapy to cope with what the perpetrator has done to them and the last person they want to know the impact is the person who did it,”“Most choose therapy for their own wellbeing but are thereby denied justice and the risk is that, rape being a serial offence, the defendant will re-offend.”
“Often, we find that rape victims are advised not to get support in terms of counselling or psychotherapy during their investigation and before the trial,” said Ms Butler. “Often that is done by talking about their sexual history – the idea, for example, that she had sex last week, or in the past, with whoever, is nothing to do with whether she was raped on the occasion in question. But it is used.
“It’s so complicated,” said Ms Butler. “We’ve got real concerns that it’s very poorly understood and that what happens in practice doesn’t follow the guidance.” Ms Addison, of Victim Support, added: “I think for a lot of victims and survivors, it makes them feel that they’re handing everything over and putting everything on hold and potentially being very much re-traumatised within that process and not feeling able to speak fully about what’s happened [in therapy] and start that journey to move forward and hopefully heal.
