Speaking in a television debate last week, the Prime Minister insisted that the first plane would leave for Kigali on 24 July, adding: “We’ve already started detaining people, the airfield’s on standby, planes are booked.”

Groups representing detained asylum seekers said they were initially freed on bail on judges’ orders following individual legal challenges for unlawful detention, but that last week the Home Office started releasing people under its own steam, before hearings at the First-Tier Tribunal had taken place.

A week before Mr Sunak called the general election, the government expanded the Rwanda scheme to include refused asylum seekers, rather than only those whose applications were deemed “inadmissible” because they arrived on small boats. “The initial cohort were all detained within about three days of the local elections and the failed asylum seekers started being taken in around mid-May,” she added.

“If there’s a change in circumstances, the Home Office has to review whether there’s a reasonable prospect of removal and obviously there’s not. They all should have been released as soon as Rishi Sunak made his announcement.”
