The Sandiganbayan Fifth Division has denied the motion to dismiss filed by BALS Enterprises proprietor Jonar Buraga Balisi Jr., one of the co-accused in the graft case filed against former officials of the Department of Agriculture (DA) Regional Field Office I, involving the reportedly irregular purchase of liquid fertilizers back in 2004.

Balisi filed a Motion to Dismiss on October 1, arguing that his right to a speedy disposition of his case has been violated because of inordinate delay incurred by the Office of the Ombudsman.

But after a careful review of his motion, the anti-graft court decided to deny it because of wrong timing. Another opportunity would have been before the presentation of evidence for the prosecution on March 7, 2019. The 10-page resolution was written by Chairperson Rafael Lagos with the concurrence of Associate Justices Maryann Corpus Mañalac and Georgina Hidalgo.
