A Scots care worker who asked to do shorter shifts when returning to her job following surgery has won almost £30,000 after her boss told her she can't just 'swan in here when feels like it'.
But an employment tribunal heard that following the conversation in which her boss dismissed her feelings, Mrs Bristow was left scared and unwell which caused her to later resign. Due to these complications, the care worker could not return to work for 14 months, the hearing was told. In February 2022, Mrs Bristow met with her line manager Fiona Mackenzie to discuss a potential 'phased' return to her job. She told her: "Don't think you can just swan in here when you feel like it and say you're coming back to work. It doesn't work like that, we don't have light duties." Miss Whyte told her if she cannot 'do a full shift' then there's 'no job' for her at the care home.
The hearing was told that days later, the care nurse received a phone call from Mrs Mackenzie to arrange another meeting but the night before Mrs Bristow was so stressed she began vomiting and was unable to sleep.
