'Isis bride' Shamima Begum wins bombshell legal fight to return home to Britain
SHAMIMA Begum has won a bombshell legal ruling to be allowed home to challenge her revoked British citizenship.
She later claimed the decision to strip her of citizenship was unlawful and took legal action against the Home Office, arguing she had been left stateless. He said she could be arrested and charged when arriving back in the UK if there is "evidence and public interest tests for prosecution for terrorist offences".Adding: "With due respect to SIAC, it is unthinkable that, having concluded that Ms Begum could not take any meaningful part in her appeal so that it could not be fair and effective, she should have to continue with her appeal nonetheless.
He said Ms Begum, who has been in the al-Roj camp in Syria, was only 15 when she left the UK, adding: "She had not even taken her GCSE exams." Fairness and justice must, on the facts of this case, outweigh the national security concerns, so that the leave to enter appeals should be allowed.Sir James Eadie QC, representing the Home Office, said: "The fact that the appellant could not fully engage with the statutory appeal procedure was a result of her decision to leave the UK, travel to Syria against Foreign and Commonwealth Office advice and align with ISIL.
