The London Victims’ Commissioner LDNVictimsComm has called out the Criminal Justice System for failing victims of rape after a major review revealed only 3% of claims in London result in convictions
According to a comprehensive new rape review conducted by the mayor’s office for policing and crime and the University of West London, only 3% of rape allegations in London result in convictions, even though the accused is known to the victim in the vast majority of cases., which analysed 501 allegations of rape made across the capital in April 2016, provides a clear picture of reported rape and the reasons for so few prosecutions.
“The system is structured to misunderstand trauma,” she said. “It’s normal for victims to have inconsistencies to memory or behave in unusual ways but that can all be used to discredit them in the process.”Despite the bleak findings, Waxman has issues a series of recommendations to help ensure that victims and survivors of rape have the best possible access to services, support and justice to keep them engaged in the criminal justice process.
The government should change the law so that all suspects under investigation for domestic abuse, sexual assault or other crimes where there are significant safeguarding issues should only be released from police custody on bail and not released under investigation Police and CPS to undergo trauma training and refreshed guidance to ensure the best evidence is gathered and the impact on the victim remains at a minimum“Why are judges still ruling that the sexual crimes of boys from ‘good families’ don’t count?”
