Special Counsel Jack Smith's report stated that evidence indicates Donald Trump engaged in an unprecedented criminal effort to overturn the 2020 election results. Smith concluded that if Trump hadn't won the election, there was sufficient evidence for a conviction. The report also details Trump's use of lies about election fraud as a weapon to undermine the democratic process.

Special counsel Jack Smith 's report said 'the evidence shows that Trump used lies as a weapon'could have been convicted at trial over the 2020 election interference case if he had not won the most recent election, Special Counsel Jack Smith has said.

Smith, who resigned in the wake of Trump’s election victory in November, also found charges could be justified against Trump’s co-conspirators but reached no final conclusions, according to the report. The report also said: “The throughline of all of Mr Trump’s criminal efforts was deceit — knowingly false claims of election fraud — and the evidence shows that Mr Trump used these lies as a weapon to defeat a federal government function foundational to the United States’ democratic process,” the report states.

After the release Trump called Smith a “lamebrain prosecutor who was unable to get his case tried before the election” in a post on his Truth Social website. The indictment charged Trump with conspiring to obstruct the election certification, defraud the US of accurate election results and deprive US voters of their voting rights.
