The Rail, Tram and Bus Union (RTBU) has won the right to resume industrial action after the Federal Court dismissed a bid by the NSW government to block work bans.The court decision effectively brings forward industrial action planned by the RTBU and five other unions, which was originally set to begin on December 28. The decision also raises the likelihood that service disruptions on New Year’s Eve will be worse than previously anticipated.

NSW Transport Minister Jo Haylen will provide an update at 2.30pm. The Labor government’s loss in the Federal Court on Thursday comes after six months of negotiations over a new pay deal for rail workers and repeated disruptions to train services for Sydney commuters. The Federal Court dismissed the government’s application for an injunction to remain in place blocking rail workers from taking a range of actions. NSW Transport Minister Jo Haylen will provide an update about industrial action on Sydney’s rail network at 2.30pm.Even if it had won, the reprieve from industrial action would have lasted only until December 28, just days before over a million people descended on Sydney’s harbour front for New Year’s Eve fireworks. That’s because the Rail Tram and Bus Union and five other unions had made a bid for a fresh round of industrial action, which would have circumvented the Federal Court case.
