Campaigner turned political staffer Sally Rugg is suing the Commonwealth and teal independent MP Monique Ryan for trying to sack her because she refused to work “unreasonable” hours.

Under the Members of Parliament Staff Enterprise Agreementstaffers are paid an allowance in recognition that they “will be required to work reasonable additional hours over and above the ordinary hours of duty”.Electorate staff are entitled to an allowance of between $2000 and $32,000 each year depending on their seniority. Personal staff are allowed between $20,000 and $32,000 depending on their level.

She is seeking a declaration that Ms Ryan was involved in the federal government’s alleged contravention of the Fair Work Act.This is because Ms Ryan is alleged to have “directly procured, induced, or having been knowingly concerned in or party to the contravention” because she was acting on behalf of the federal government as the employing MP.

Guidelines issues by the Finance Department said employees are “not to work unreasonable additional hours even where they receive an allowance,” and MPs and staff should agree on expectations when discussing or entering into arrangements regarding additional hours of work. Considerations of what constitutes “unreasonable” includes risk to health and safety, employee circumstances and family responsibility, workplace operational requirements, necessity and nature of the employee’s role.as “an outstanding all-rounder with excellent leadership experience, a proven track record of effective policy advocacy, and high-level strategic communications skills” on her website.
