The accused denies both charges. During a police call, the victim was seen lying unconscious on the floor from alcohol, while the defendant was seen holding an unbroken beer bottle.
It is alleged that the defendant had previously threatened to slit the other teenager's throat and told a girl 'his future is in your hands.' Prosecutor Stuart Lody told the court that police who arrived at the scene in the early morning of July 28th heard a noise resembling a dog's howl. They discovered a body lying next to a hedge, face down, with a scooter placed on top. Officers observed blood at the scene and immediately placed the victim in the recovery position. The accused teenager, who cannot be named due to his age, has already pleaded guilty to the lesser charge of unlawful wounding. The prosecution explained that the defendant has admitted to carrying out the attack and wounding the victim. However, the prosecutor stated that the jury must determine the defendant's state of mind during the incident.
