Tesla faces a lawsuit over alleged safety flaws after a woman's Tesla Model X allegedly accelerated, injuring her and her unborn child.

In 2018, Mallory Harcourt— a pregnant woman and the owner of a Tesla Model X— found herself in a rather terrifying situation.

However, the vehicle proved contrary to the company’s claims. On December 27, 2018, just two days after Christmas and four after their purchase, Harcourt’s 2-year-old son was able to start the car, leading to the vehicle moving forward and hitting her at their home in Santa Barbara, California. Now, a jury trial will decide if Tesla is guilty of consumer fraud for falsely advertising the Model X’s technology as safe and negligence for “alleged flaws” in its software design.

Harcourt then realized she had left her house keys at her husband’s office and couldn’t get inside. As she needed to change her son’s diaper, she grabbed a diaper bag from the Tesla and went to set up a changing station in the garage.

Tesla rebutted, denying that the 2018 Tesla Model X had any defects. The company argued that Harcourt’s injuries were “a result of Ms. Harcourt’s own negligence in leaving her son unattended.
