The men were charged after a grand jury presentment relating to the 2022 shooting.
Nathaniel Jimenez, now 32, Rafael Jimenez, now 22, and a juvenile, now 18, were all charged by the Lancaster City Bureau of Police after a Lancaster County grand jury investigation heard testimonies from people who previously refused to fully cooperate. All three men lived in the house on the 500 block of Woodward Street where the shooting occured.
Rafael, the 3-year-old’s father, and Nathaniel were the only adults in caretaking roles when the shooting happened. The juvenile left shortly before the shooting, leaving his firearm loaded on a dining table accessible to four minors in the residence. After the shooting, Nathaniel called 911 and left the scene to get Rafael, who was around the block. Rafael grabbed the 3-year-old and ran from the scene.
The gun was a “ghost gun,” police said, meaning it is untraceable and illegal. Lab tests confirmed the fatal bullet came from the firearm and the juvenile’s DNA was on it. Witnesses told the grand jury they had seen the juvenile “play” with the gun many times and that he often sold drugs out of the house.
