A transgender doctor has described feeling 'unsafe and upset' after a nurse made 'hurtful and demeaning' remarks to her in a women's changing room at work. Dr Beth Upton, 29, told an employment tribunal that nurse Sandie Peggie compared her to transgender rapist Isla Bryson and told her that 'as a man' she 'couldn't be in the changing room'. The incident occurred on Christmas Eve 2023 at Victoria Hospital in Kirkcaldy, Fife, leading to Ms Peggie's suspension in January 2024.

Ms Peggie has lodged a complaint against NHS Fife and Dr Upton, alleging sexual harassment or harassment related to protected beliefs under the Equality Act 2010. She claims the harassment stems from three changing room incidents.Dr Upton, who identifies as a woman and uses she/her pronouns, began gender transition in January 2022 and started working at the A&E department in August 2023. During a meeting with her manager that month, she confirmed that she had used the women's changing room previously at work. Dr Upton stated that, based on her understanding, her identity as a woman should be sufficient to use the women's facilities. The tribunal heard that Ms Peggie had left the changing room on two occasions while Dr Upton was present, standing outside. Dr Upton believed this was due to her being transgender.During the third incident, on Christmas Eve 2023, Dr Upton said that Ms Peggie told her that the changing room was for women only and that she didn't belong there. Ms Peggie allegedly claimed she felt intimidated by Dr Upton's presence and that others shared her discomfort. Dr Upton apologized to Ms Peggie but asserted her right to use the changing room. She explained that if Ms Peggie had a problem, she should raise it formally. According to Dr Upton, Ms Peggie insisted she couldn't be in the room, stating that she was 'not a woman' and that it was 'not safe'. Ms Peggie allegedly questioned Dr Upton about her chromosomes, comparing the situation to 'prisons', a reference believed by Dr Upton to be about Isla Bryson, a transgender rapist who was initially housed in a women's prison before being transferred to a male prison. Dr Upton felt that Ms Peggie was implying her presence in the changing rooms was analogous to that of a sexual predator. She recounted feeling 'unsafe and upset' by the nurse's hurtful and demeaning remarks and described the situation as deeply uncomfortable and upsetting
