Former President Donald Trump has requested the Supreme Court to halt his upcoming sentencing in a New York hush-money case, citing presidential immunity.
A federal court has asked New York prosecutors to respond to Donald Trump 's request for a stay of proceedings in his hush-money case by Thursday morning. Trump's lawyers argue that he is protected by presidential immunity, citing a recent Supreme Court ruling. They claim the case should be dismissed because it is a 'meritless hoax.' Trump faces sentencing in May for falsifying records related to hush money payments made to adult film star Stormy Daniels during the 2016 presidential campaign.
Judge Juan Merchan initially postponed Trump's sentencing following the Supreme Court's ruling on presidential immunity but later concluded that Trump does not have immunity until he is sworn in as president. The Supreme Court's ruling on immunity came in a separate case against Trump regarding his alleged attempts to overturn the 2020 presidential election results. That case has since been dropped. Trump's request to the Supreme Court was filed by lawyer D. John Sauer, whom Trump intends to appoint as solicitor general. Another Trump lawyer listed on the filing, Todd Blanche, is Trump's pick to be deputy attorney general
