The two-child cap prevents parents from claiming the child element of Universal Credit or child tax credit for any subsequent child
Two mothers and a leading poverty group are challenging the government in court over the Universal Credit two-child benefit policy. The move is the second legal challenge facing the Chancellor after the Labour supporting Union, Unite, said it plans to launch a judicial review on what it claims was an illegal decision to remove the Winter Fuel Payment from millions of pensioners
The Child Poverty Action Group , which is providing legal representation for them, said the policy was "discriminatory and irrational". The charity’s head of strategic litigation, Claire Hall, said: "They should be able to get the exemption for the non-consensually conceived children, irrespective of at what point they are born."
"We live very frugally and the children do not have treats or days out. This makes me feel very guilty and unworthy as a parent.”
