Arrested for an offense she had no way to know she committed, Kendall Reed found no one in the legal system willing to listen.

“I was devastated in that moment,” Kendall said in her soft voice. The closest thing to trouble she had ever been in was a few tardy slips in high school. Now packed alongside women facing more serious charges, she told herself she couldn’t show weakness.In summer 2022, Kendall decided she was ready to leave her mom’s home and be on her own. With savings from her restaurant job, she pulled her silver Ford Fusion out of repossession and rented her first apartment.

Three miles south of the restaurant, a Plano police officer stopped them. He walked to Kendall’s side of the car and advised them of the expired registration. According to the arrest affidavit, he noticed a strong marijuana odor. When she went before the judge for the formal charge and bond, she expressed her confusion: “Ma’am, I bought it from the corner store. I’m not exactly sure how this can be illegal.”

“They’re not supposed to arrest you for that,” he recalled telling her, “because in Texas that product’s legal. It was under 0.3% .” Madson started digging and learned a previous letter advising Kendall of the court date omitted her apartment number. It had been returned to Collin County stamped “inadequate address.”grand jury already had indicted her on the felony drug charge. Forensic testing of the vape pen had revealed delta-9 THC with a concentration of 2.53%, about seven times over the Texas statutory minimum, Collin County DA Greg Willis told me via email.

“With statutes, we can clean this mess up,” he said. “It was foretold this could happen, and now we’ve got people getting high off of something in Texas we have said we don’t do.” Each time Madson hung up, she would turn to whomever was in the room and say, “I am so angry. This is not right.”
