THE Department of Justice has denied the motion filed by suspended Bureau of Corrections Director General Gerald Bantag to inhibit the panel of prosecutors conducting the preliminary investigation of the two murder charges filed against him in the killing of a broadcaster and a person deprived of liberty who has been tagged as a middleman in the slay case.The DoJ denied Bantag's motion for lack of merit.

5, 2022In filing the motion, Balisong argued that the DoJ lacked the jurisdiction to handle the cases filed against his client.He said Bantag's post as BuCor chief is salary grade 30 and should be under the jurisdiction of the Office of the Ombudsman.Balisong said that under the law, all offenses committed by any public official salary grade 27 and above should fall within the Sandiganbayan therefore the preliminary investigation should fall under the jurisdiction of the Ombudsman.
