Special Counsel Jack Smith may be able to reverse Judge Aileen Cannon's dismissal of Donald Trump's classified documents case, legal experts have said.On Monday night, the Department of Justice rapidly authorized Smith to appeal the decision to the 11th Circuit U.S. Court of Appeals.Carl Tobias, a law professor at the University of Richmond in Virginia, told Newsweek that Smith can either file his 11th circuit appeal or he may appeal directly to the Supreme Court.
'There is no way to know for sure what the Supreme Court will say, but given the Supreme Court's extremely broad view of separation of powers in the Trump immunity case, I think there is a good chance that the Court will agree with Judge Cannon that the broad unsupervised powers given to Jack Smith are unlawful, and that the Special Counsel regulation is overbroad,' he said.
