The Justice Department shared portions of Special Counsel Jack Smith's report with Congress, focusing on alleged efforts to overturn the 2020 election and the January 6th Capitol attack. The report initially planned to include information about Trump's prosecution for retaining classified documents, but that aspect was withheld due to ongoing legal proceedings. Smith stated that sufficient evidence existed for a conviction if Trump faced trial, but the department's policy prohibits indicting and prosecuting a sitting president.

Trump was indicted in August 2023 on four felony charges connected to January 6: conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding, and conspiracy against rights.
