WILLIAMSPORT — A three-year-old legal dispute between the Lycoming County commissioners and its elected controller over control of certain fiscal functions has ended with an agreement on legal fees.All that is left is for the dismissal of the lawsuit that was stayed in April to give the parties the opportunity to negotiate a settlement.
Potter County Senior Judge John B. Leete who was assigned the case until recently, awarded Rogers in a Dec. 1, 2022, order the cost of her litigation. It began in 2019 when commissioners then in office approved transferring at Rogers’ request those fiscal functions and four employees to her. Leete three times ruled in favor of Rogers. After the third time, the commissioners last year by a 2-1 margin voted to appeal to the Commonwealth Court.Leete stating the commissioners relied on an erroneous interpretation of the County Code to claim it had authorization to remove the fiscal functions from the controller.
