A recent change in the law might allow some older individuals receiving Personal Independence Payment ( PIP ) with a lower mobility award to request a reevaluation of their claim by the Department for Work and Pensions ( DWP ). This legal change applies specifically to claimants over State Pension age and their eligibility for an enhanced mobility award.The DWP has released new guidance clarifying that this change only affects PIP claims reviewed between April 8, 2013, and November 20, 2020. The change stems from a tribunal ruling on May 22, 2020, which uncovered an unintentional loophole in regulation 27 of the Social Security (Personal Independence Payment) Regulations 2013. The guidance states that the DWP lacked the legal authority to restrict the mobility award for claimants receiving the standard rate of mobility and over State Pension age based on new medical evidence. New medical evidence refers to a report from a health professional requested by the DWP that recommended the enhanced mobility award. The DWP could only restrict the mobility award for claimants if a relevant change in circumstances was identified after they reached State Pension age. To rectify this unintended gap, changes to PIP regulations took effect from November 30, 2020. The DWP has also created a dedicated page on GOV.UK to assist individuals in checking their eligibility and requesting a review of their PIP claim if their mobility award could not be increased due to reaching State Pension age. The enhanced mobility rate is valued at £75.75 each week during the current financial year, amounting to approximately £303 every four-week pay period. Receiving this award could also enable someone to participate in the Motability Scheme, which aids in transportation.Eligibility for an increased mobility payment, even if someone has stopped receiving PIP, exists if the following conditions are met: the DWP utilized a health professional report during the claim review, the individual did not report a change in their mobility needs, and they reached State Pension age. The DWP emphasizes that current PIP recipients will not experience a reduction in their award due to this change. However, they add that they cannot reconsider decisions made by a tribunal. To apply for a review, individuals can contact the PIP enquiry line at 0800 121 6579 and state they are inquiring about the ‘Regulation 27 administrative exercise review’. They will need their National Insurance number. Alternatively, individuals can contact them via post, with full details available on the GOV.UK website. The DWP will inform applicants if they require additional information to support their application. If eligibility criteria are met, the DWP will assess if a higher payment should have been made.
