Leading barrister Peter Joyce KC warns that defendants in serious cases could walk free due to the 'chaos' within the justice system. Years of underfunding have left courts in disrepair and facing a record backlog of cases, with trials delayed for years. Joyce fears the system is on the brink of collapse and calls for urgent action to prevent further deterioration.

A leading barrister has expressed grave concerns about the state of the justice system in England and Wales, warning that defendants facing serious charges, such as rape, could walk free due to its current state of disarray. Peter Joyce KC, who has dedicated 56 years to prosecuting and defending individuals accused of crimes ranging from murder to sexual abuse, has characterized the system as 'a shambles' brought about by years of underfunding.

He fears the criminal justice system is on the brink of collapse and that urgent action is needed to prevent further deterioration.Joyce's warning comes amidst reports of widespread problems within the courts. In January, several crown courtrooms in Nottingham were forced to close due to leaks and faulty heating, highlighting the physical deterioration of many court facilities. Judge Shant KC, the Honorary Recorder of Nottingham, appealed for patience from staff and the public as they grappled with these 'very challenging circumstances'. Joyce, who led the prosecution of notorious sex offender Frank Beck in 1991, cites the astronomical backlog of cases as a major cause for concern. Figures released by the Ministry of Justice (MoJ) reveal that 73,105 trials remained unheard at the end of September, nearly double the number in 2019. This backlog, Joyce argues, is fueled by an influx of cases exceeding the system's capacity to process them. He paints a grim picture of victims of sexual assault waiting years for their trials, with cases adjourned multiple times, leading to disillusionment and withdrawal from the legal process.'You have people who have complained of rape say in 2020, 2021, 2022, whose trials are not going to happen until 2026, in some cases 2027,' Joyce lamented. 'Their cases are adjourned, and it happens two or three times, and eventually they say 'blow it, I cannot be bothered to engage with this any longer.'What I was once proud of has now become a shambles and a disgrace. It was a Rolls-Royce service, and now it's more like a broken-down East German Trabant.' The MoJ acknowledges the challenges facing the justice system and points to recent efforts to address them. They highlight the funding of an additional 2,500 sitting days, increasing court capacity to its highest level in nearly a decade. However, Joyce's stark warning suggests that these measures may not be enough to avert a full-blown crisis. He calls for 'radical' steps to be taken to tackle the 'crisis' and restore public confidence in the justice system
