Man BANNED from attending court to see tragic brother's attacker 'as it would have caused criminal stress'
A man who found his vulnerable brother lying dead weeks after a vicious assault says he was banned from attending court to look the teenage attacker in the eye and "see if he was sorry".
The court had heard David, who had long-standing mental health issues and walked with a stick, suffered a bleed on the brain and spent eight days in hospital after confronting the teenage burglar late on October 25 last year. Tom, as he did every week, had agreed to run some errands for David the following day. But on the morning of November 15, puzzled as to why he could not get hold of David on the phone, Tom called round only to find David lying unresponsive on his kitchen floor. After realising his brother had died, Tom contacted the police himself who ramped up their investigation.
Despite the confusing blow, Tom said he clung to the fact he would still be able to read his victim personal statement in court and address the boy who caused his brother so much suffering. One thing Tom had wanted to tell the boy was that he believed David would have forgiven him due to his strong Christian faith. In his victim statement, which he bravely read to the ECHO in a powerful video attached to the ECHO article, he said: "For your own sake, prove that he would be right to offer you that huge concession."
Tom said: "I was always amazed, I would take him down Grange Road and the number of people who would shout over 'Hello David, how you doing?'. He was honestly so well known."
